Other Eligibility Requirements
To qualify for in-state tuition as an undocumented immigrant in Texas under S.B. 1528 (formerly H.B. 1403), a student must meet the following requirements:
·        S/he must have graduated from a Texas public or private high school, or obtained a GED.
·        S/he must have lived in Texas for at least 3 years prior to the high school graduation date; AND
·        S/he must provide to the institution an affidavit stating that s/he will file an application to become a permanent resident at the earliest opportunity eligible to do so.  
It is important to note that this law also covers those students under:
·          NACARA, the Nicaraguan Adjustment and Central American Relief Act, which provides various forms of immigration benefits and relief from deportation to certain Nicaraguans, Cubans, Salvadorans, Guatemalans, nationals of former Soviet bloc countries, and their dependents.
·          TPS, Temporary Protected Status, which is a temporary immigration status granted to eligible nationals of designated countries (or parts thereof) who are temporarily unable to safely return to their home country because of ongoing armed conflict, the temporary effects of an environmental disaster, or other extraordinary and temporary conditions.
